EGMR: Forthcoming judgment on 13 November 2014 – Islam-Ittihad Association and Others v. Azerbaijan (application no. 5548/05)

The applicants are the Islam-Ittihad Association, an NGO with headquarters in Baku, which was active between 1991 and 2003, and Azer Samadov and Ilgar Allahverdiyev, Azerbaijani nationals who were born in 1961 and 1973 respectively and live in Baku. They were the association’s chairman and a member of its management board, respectively. The association’s main activities included the repair and maintenance of mosques, and it engaged in projects aimed at promoting respect for human rights and in a number of humanitarian activities. EGMR: A company’s inability to challenge the Roman Catholic Church’s entry in the land register relating to property previously registered by the company violated its ownership rights

In today’s Chamber judgment in the case of Sociedad Anónima del Ucieza v. Spain (application no. 38963/08) the European Court of Human Rights held, unanimously, that there had been a violation of Article 6 § 1 of the European Convention on Human Rights, and held by a majority, that there had been a violation of Article 1 of Protocol No. 1 to the Convention. The case concerned a dispute over ownership of a medieval church between the applicant company, which had purchased and registered in the land register a plot of land in which the church had formed an enclave, and the Diocese of Palencia, which had registered the same church in its own name in the land register sixteen years later. SG Gießen: Beerdigungskosten können nicht aus überzahlter Rente beglichen werden

Das SG Gießen hat die Klage einer 62-jährigen Frau aus Gießen abgewiesen. Diese hatte ihre Tante bis zu deren im Alter von 90 Jahren eingetretenen Tod betreut und besaß auch eine Kontovollmacht. Die Deutsche Rentenversicherung erfuhr von dem Tod erst später und zahlte noch Rente für den nachfolgenden Monat. Sie wandte sich zunächst an die kontoführende Bank der verstorbenen Rentnerin und verlangte eine Rücküberweisung der zu viel gezahlten Rente. Die Bank teilte aber mit, das Konto weise ein Minus auf, zuletzt habe die Klägerin als Kontobevollmächtigte über einen Betrag i.H.v. 1.600 € verfügt. EGMR: Public prosecutor breached a clergyman’s right to be presumed innocent by declaring him guilty in a decision discontinuing time-barred proceedings

In today’s Chamber judgment in the case of Peltereau-Villeneuve v. Switzerland (application no. 60101/09) the European Court of Human Rights held, unanimously, that there had been a violation of Article 6 § 2 (presumption of innocence) of the European Convention on Human Rights. The case concerned an alleged breach of the right to be presumed innocent on account of terms used by the public prosecutor in a discontinuance decision finding that criminal proceedings for sexual abuse were time-barred. VG Frankfurt a.M.: Jüdin aus der Ukraine als Flüchtling anerkannt

Die 7. Kammer des VG Frankfurt a.M. hat am 04.08.2014 das Bundesamt für Migration und Flüchtlinge verpflichtet, einer ukrainische Staatsangehörigen jüdischer Volks- und Religionszugehörigkeit die Flüchtlingseigenschaft im Sinne der Genfer Flüchtlingskonvention zuzuerkennen. Das Urteil beruht auf der Feststellung, dass die Klägerin auf Grund ihrer Religionszugehörigkeit in der Ukraine sowohl bei der Arbeitssuche, als auch bei der Ausübung ihrer beruflichen Tätigkeit benachteiligt wurde und es zu Übergriffen Privater auf ihr Geschäft kam, sowie darauf, dass sie durch die zuständigen Polizeibehörden keine Unterstützung erhielt. EGMR: Severe harassment of Jehovah’s Witnesses in Georgia was tolerated by the authorities in 2000-2001

The case Begheluri and Others v. Georgia (application no. 28490/02) concerned the severe harassment of a large number of Jehovah’s Witnesses in Georgia in the years 2000-2001. The Court found in particular that the State authorities had been ineffective in preventing and stopping religiously motivated violence. State officials had either directly participated in the attacks on Jehovah’s Witnesses or they had tolerated violence by private individuals against members of the religious community. The authorities had thus created a climate of impunity, which encouraged further attacks throughout the country. VG Osnabrück: Altäbtissin hat Anspruch auf Zahlung von Bezügen

Das VG Osnabrück hat die Klage des Stiftes Börstel, das sich gegen eine aufsichtsrechtliche Verfügung des Beklagten, des Präsidenten der Klosterkammer, gewendet hat, abgewiesen. Zur Begründung führte das Gericht aus, die angefochtene Verfügung sei rechtmäßig. Die dem Verfahren beigeladene 88-jährige Altäbtissin habe einen Anspruch auf (Weiter-)Zahlung der Altäbtissinnenbezüge aus der Satzung des Stiftes. Nach umfangreicher Auslegung dieser Satzung ist das Gericht zu der Auffassung gekommen, der Altäbtissin seien unabhängig von ihrer Bedürftigkeit die Bezüge zu zahlen. Das Stift Börstel stand auf dem Standpunkt, der Altäbtissin keine Bezüge zahlen zu müssen, da sie unabhängig von den Bezügen des Stiftes über ein Einkommen über der Bedürftigkeitsgrenze verfüge. EGMR: Turkey must reform religious education in schools to ensure respect for parents’ convictions

In today’s Chamber judgment in the case of Mansur Yalçın and Others v. Turkey (application no. 21163/11), which is not final, the European Court of Human Rights held, unanimously, that there had been a violation of Article 2 of Protocol No. 1 (right to education) to the European Convention on Human Rights with regard to Mansur Yalçın, Yüksel Polat and Hasan Kılıç. In this case, the applicants, who are adherents of the Alevi faith, an unorthodox minority branch of Islam, complained that the content of the compulsory classes in religion and ethics in schools was based on the Sunni understanding of Islam.
