In today’s Chamber judgment in the case of Aygün v. Belgium (application no. 28336/12) the European Court of Human Rights held, unanimously, that there had been a violation of Articles 8 (right to respect for private and family life) and 9 (freedom of thought, conscience and religion) of the European Convention on Human Rights. In this case the applicants complained of the investigating judge’s refusal to allow them to transfer their sons’ bodies to Türkiye, their country of origin, while the investigation was ongoing.
