The four applicants, Çağlar Buldu, Barış Görmez, Ersin Ölgün and Nevzat Umdu are Turkish nationals, who were born between 1972 and 1983 and live in Istanbul and İzmir, except for Mr Görmez, who was being held at the Isparta military prison when he lodged his application. EGMR: Religious communities’ loss of full church status breached their rights to freedom of religion and freedom of association

In today’s Chamber judgment in the case of Magyar Keresztény Mennonita Egyház and Others v. Hungary (application nos. 70945/11, 23611/12, 26998/12, 41150/12, 41155/12, 41463/12, 41553/12, 54977/12 and 56581/12), which is not final, the European Court of Human Rights held, by a majority, that there had been: a violation of Article 11 (freedom of assembly and association) read in the light of Article 9 (freedom of thought, conscience and religion) of the European Convention on Human Rights. EGMR: Forthcoming judgment on Tuesday 8 April 2014 – Magyar Keresztény Mennonita Egyház and Izsák-Bács and Others v. Hungary (nos. 70945/11, 23611/12, 26998/12, 41150/12, 41155/12, 41463/12, 41553/12, 54977/12 and 56581/12)

The applicants are various religious communities, some of their ministers and some of their members. Prior to the adoption of a new Church Act, which entered into force in January 2012, the religious communities were registered as churches in Hungary and received State funding. Under the new law only a number of recognised churches continued to receive funding. All other religious communities, including the applicants, lost their status as churches but were free to continue their religious activities as associations. Following a decision of the Constitutional Court, which found certain provisions of the new Church Act unconstitutional, religious communities such as the applicants could continue to function and to refer to themselves as churches. However, the law continued to apply in so far as it required the communities to apply to Parliament to be registered as incorporated churches if they wished to regain access to the monetary and fiscal advantages they had previously enjoyed. EGMR: Structure of primary education in Ireland in the 1970s failed to protect a schoolgirl from sexual abuse by her teacher

In today’s Grand Chamber judgment in the case of O’Keeffe v. Ireland (application no. 35810/09), which is final, the European Court of Human Rights held: by 11 votes to 6, that there had been a violation of Article 3 (prohibition of inhuman and degrading treatment) and of Article 13 (right to an effective remedy) of the European Convention on Human Rights concerning the Irish State’s failure to protect Ms O’Keeffe from sexual abuse and her inability to obtain recognition at national level of that failure; and unanimously, that there had been no violation of Article 3 of the European Convention as regards the investigation into the complaints of sexual abuse at Ms O’Keeffe’s school. The case concerned the question of the responsibility of the State for the sexual abuse of a schoolgirl, aged nine, by a lay teacher in an Irish National School in 1973. The applicant, F.G., is an Iranian national who was born in 1962 and is currently in Sweden. He applied for asylum and a residence permit in Sweden in November 2009, stating in particular that he had been active in the opposition movement, that he had been arrested on two occasions, and that he had converted to Christianity after coming to Sweden. He therefore risked persecution if returning to Iran. He also submitted a summons to the Revolutionary Court in Iran ordering him to present himself at Evin prison in Teheran in November 2009. Shortly afterwards he was allegedly abducted, confined then tortured for several days before managing to escape from his kidnappers. EGMR: Grand Chamber hearing concerning the prohibition on wearing the full-face veil in public in France

The European Court of Human Rights held a Grand Chamber hearing on Wednesday 27 November 2013 at 9.15 a.m. in the case of S.A.S. v. France (Application no. 43835/11). The case concerns the complaint of a French national, who is a practising Muslim, that she is no longer allowed to wear the full-face veil in public following the entry into force, in April 2011, of a law prohibiting concealment of one’s face in public places.
